Information for the tentant in accordance with the Consumer Contracts Act


You are now entering into an agreement to rent a residential lease. 

Before you sign the rental contract, we must make you aware that you may be covered by the rules on distance sales according to the Consumer Contracts Act. You will be if it was not the landlord or a representative of the landlord who showed you the apartment.

If you are covered by the rules on distance selling, then the landlord has a special obligation to provide information according to Section 8 of the Consumer Agreements Act.

Part of the information that the landlord must provide in connection with distance sales is already shown in the forwarded lease. In addition, we must provide the following.

 

Right of withdrawal according to the Consumer Contracts Act

In the case of distance selling, the consumer (tenant) can withdraw from the agreement. If the tenant wishes to use this right of cancellation, the tenant must notify the landlord in writing no later than 14 days after the latest of the following times:

 

1. The day the consumer received notification that the agreement had been concluded (which in practice means the day the tenant received the lease back signed by the landlord).

2. The day the tenant received this information, however no later than 12 months after the day the tenant received notification that the rental agreement had been entered into.

 

If the tenant has taken the tenancy into use before the right of withdrawal is exercised, the landlord can demand that the tenant pays for the period the tenant has had access to the tenancy. The lease contract’s other terms regarding, among other things, eviction, including renovation of the apartment, continues to apply.

If the consumer (lessee) wishes to make use of the right of withdrawal, this must be done by submitting an unequivocal statement to the name and address of the landlord specified in § 1 of the lease. The tenant can choose to use the law’s standard withdrawal form below.
